1. Acceptance of these terms

By accessing or using TripFinder.ca, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

2. Who we are

TripFinder.ca is operated by HighBar Enterprises Ltd., a company based in Alberta, Canada. You can reach us at hello@tripfinder.ca.

3. What TripFinder is — and is not

TripFinder is a travel comparison and referral service. We help you compare small-group tours from independent tour operators and connect you with a TripFinder travel agent who can help arrange a booking.

We are not a tour operator. We do not own, organize, or run the tours listed on the Site. The travel services are provided by independent operators such as G Adventures, Intrepid Travel, Exoticca, Exodus Adventure Travels, and Trafalgar. Any booking you make is a contract between you and the operator, and is subject to that operator’s own terms and conditions — including their booking, payment, cancellation, and refund policies.

4. Eligibility

You must be at least 18 years old — the age of majority in Alberta — and able to enter into a legally binding contract to submit a quote request or arrange travel through TripFinder. By using the Site, you confirm that you meet this requirement.

5. Quote requests

When you submit a quote request, you are asking us to help you get pricing and availability for the trip(s) you select. You agree that:

• The information you provide is accurate and complete;
• You consent to be contacted by a TripFinder travel agent about your request;
• We may share the details needed to fulfill your request with the relevant tour operator(s); and
• A quote is not a confirmed booking. Prices, availability, and trip details are not guaranteed until confirmed in writing by the operator, and a booking is only final once you have completed the operator’s booking process.

6. Accuracy of trip information

Trip information on the Site — including itineraries, inclusions, prices, dates, and availability — is sourced from tour operators and third-party data feeds and is updated periodically. While we work to keep this information accurate, it may be incomplete, out of date, or contain errors, and it may change at any time without notice. Nothing on the Site is a binding offer. Always confirm the current details with us or the operator before making travel decisions.

7. Affiliate and commission disclosure

TripFinder earns money to keep the service free for travellers. When you book travel through us or through links on the Site, we may receive a commission or affiliate fee from the tour operator. This does not increase the price you pay. Our goal is to recommend trips based on what suits you, regardless of the commission involved.

8. Acceptable use

When using the Site, you agree not to:

• Use the Site for any unlawful, fraudulent, or harmful purpose;
• Copy, scrape, harvest, or systematically collect data or content from the Site without our permission;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Site, its servers, or its systems;
• Introduce viruses or other harmful code; or
• Use the Site in any way that could damage, disable, or impair it, or interfere with anyone else’s use of it.

9. Intellectual property

The Site and its content — including text, design, logos, and the TripFinder name — are owned by HighBar Enterprises Ltd. or our licensors and are protected by intellectual property laws. Trip descriptions, images, and other operator materials remain the property of the respective tour operators. We grant you a limited, personal, non-transferable licence to use the Site to research and arrange travel. You may not reproduce, distribute, or create derivative works from the Site’s content without our permission.

10. Third-party websites and content

The Site contains links to, and content from, third-party websites, including tour operators. We provide these for your convenience and do not control or endorse them. We are not responsible for the content, products, services, or practices of any third-party website. Your dealings with any operator or third party are solely between you and them.

11. Disclaimers

The Site is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including that the Site will be uninterrupted, error-free, or secure, or that the trip information is accurate, complete, or current. Travel involves inherent risks, and you are responsible for evaluating whether a trip is suitable for you.

12. Limitation of liability

To the fullest extent permitted by law, HighBar Enterprises Ltd. and TripFinder will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Site or your dealings with any tour operator. Because we are not the tour operator, we are not responsible for the travel services themselves — including any cancellation, delay, injury, loss, or other issue arising from a trip. Your remedies in connection with a trip are with the operator that provides it.

13. Indemnity

You agree to indemnify and hold harmless HighBar Enterprises Ltd. and TripFinder from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Site or your breach of these Terms.

14. Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after an update means you accept the revised Terms.

15. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict-of-law principles. You agree that the courts located in Alberta, Canada will have exclusive jurisdiction over any dispute arising from these Terms or your use of the Site.
